Family Members of EU citizen
-
Overview
Third-country nationals who are family members of EU citizens derive their rights under the Directive (2004/38/EC) from EU citizens, the holders of the primary status. In principle, they do not enjoy any autonomous right to move and reside freely. Core’ family members have an automatic right of entry and residence, irrespective of their nationality.
Changes regarding visas for the following categories of family members of EU citizens:
- spouse, with marriage already registered in the EU Member State;
- partner that has contracted a civil union with the EU citizen and the said union has been registered in the said state;
- direct descendants of the EU citizen under 21 years of age or dependant on the EU citizen, including those of the spouse or partner of the EU citizen;
- dependant parents and grandparents of the EU citizen, including those of the spouse or partner of the EU citizen.
The above persons applying for visas to join the EU citizen and live permanently in the EU Member State shall apply for a National (Type ‘D’) Family Reunification Visa. The EU citizen must be resident in the EU Member State.
For the same categories of family members of EU citizens intending to travel to the EU Member State for a visit the visa to be applied for is a Tourist Visa.
The visa is free of charge in both cases.
The Nulla Osta for Family Reunification is not required.
The Proof of Sponsorship and/or Private Accommodation form must indicate if the visa applicant is going to live in the EU state permanently or is visiting, to determine which visa type they will apply for.
The visa applicant must produce document(s) proving their relationship with the EU citizen.
In the event that you wish to remain in the Member State for more than 90 days as a family member of a EU citizen exercising his/her free movement rights, you must apply (when in the Member State) for a Residence Card of a family member of an EU citizen.
