Family Members Of Eu Citizen
Visa procedures for the short stay of Family Members of EU Citizens (up to 90 days)
I. Who is a family member of an EU citizen?
A family member of an EU citizen is a family member of a citizen of any of the EU country or Iceland, Lichtenstein, Norway and Switzerland, who is a:

- cannot systematically prepare for a future profession or perform gainful activities due to illness or injury; or
- is not capable of performing systematic gainful activities due to a chronic adverse health condition.
A family member of an EU citizen can also be understood to be a foreign national who can credibly prove that:
they are a relative of an EU citizen that is not specified above if:
- they lived in a common household with an EU citizen in the country whose citizenship they hold or in the country in which they held long-term or permanent residence;

- they cannot care for themselves without the personal care provided by an EU citizen due to a chronic adverse health condition; or

The provisions of the Act on Residence of Foreign Nationals pertaining to family members of European Union citizens will be also be applied to a foreign national who is a family member of a citizen of the Czech Republic
II. Short-term stay (up to 90 days)
Visa Waiver
Family members – non-EU citizens subject to visa requirements, can stay in the Czech Republic for up to 3 months without a visa on condition that they hold a valid passport and a valid document on a temporary or permanent residence permit issued by a different EU country, Iceland, Norway, Liechtenstein or Switzerland, or a permanent residence card issued by a different EU country.
Likewise, family members can stay in the Czech Republic temporarily without a visa if their short-term visa has become invalid. They must, however, reside in the Czech Republic with a citizen of the EU or the abovementioned states and their stay in the Czech Republic shall not exceed 3 months.
Visa Requirements
Fully completed and signed application form for a schengen visa should be submitted by the applicant in person together with:

The visa application for family members of EU nationals is free of charge. The general processing time is fourteen days, but it might be extended, especially if the supporting documentation is not sufficient. In case of missing proof of the EU citizen identity and the family relationship, the applicant cannot be considered to be a family member of an EU citizen and standard rules of procedures will be applied.
Appeal Procedure
The procedure in case of the visa refusal is the same for family members as for any other schengen visa applicants. The request for an appeal must be lodged within 15 days of the receipt of visa refusal via the diplomatic mission, at which the visa application has been filed. The appeal should include the name of the applicant and describe the reasons, why the applicant considers the refusal decision to be in contrary to the law. The Ministry of Foreign Affairs will review the request in 30 days from the receipt of the appeal. The information on the outcome of the review is sent to the applicant via the same diplomatic mission.
The important difference for EU family members is the right for further appeal to the court. Thus, the negative outcome from the Ministry of Foreign Affairs can be appealed at the respective administrative court (Municipal Court in Prague). The appeal to the Municipal Court in Prague should be in writing within 30 days to its address: Městský soud v Praze, Hybernská 18, 111 21 Praha 1, Czech Republic.

Appeal procedure: (from the following source: https://ipc.gov.cz/en/administrative-proceedings/appeal/ )
The Legal Effect of Decisions and Appeals
Applicants can appeal against a decision to reject their application within a time limit of 15 days from the day they received the decision. If you file an appeal, the decision to reject your application will come into effect only on the day that the decision of the Commission for decision-making in matters related to the residence of foreigners to reject or to change the appeal has been served. The Commission’s decision cannot be appealed.
If you do not file an appeal, the decision to reject your application will come into effect on the day following the last day of the 15-day time limit for filing an appeal. If you renounce the right to appeal, the decision comes into effect on the day you renounce this right.
You can also appeal against the decision to close the proceedings.
You must submit the appeal in person in written from at the address of the office that issued the contested decision, or by post, via Data Box, by e-mail with recognised electronic signature, or through legal representative. If you decide to send the appeal by post, the day of posting is important for complying with the given time limit. If you post the appeal at a post licence holder (Česká pošta) on the last day of the time limit, the time limit for filing an appeal will be complied with.
The appeal must contain information about:
-against which decision it is directed,
-to what extent the appeal contests the decision,
-where there is a conflict with the law or where the decision or the proceedings that had preceded it were incorrect1.
If it is not specified in the appeal to what extent the appellant contests the decision, it is understood that the appellant is seeking the revocation of the entire decision.
If the Commission concludes that the contested decision is in conflict with the law or it is incorrect:
-it will revoke the contested decision or part thereof and close the proceedings,
-it will revoke the contested decision or part thereof and refer the matter back to the administrative authority that had issued the decision for a new assessment,
-it will change the contested decision or part thereof.
If the Commission does not find reasons to proceed in any of the abovementioned ways, it will reject the appeal and confirm the contested decision. If it changes or revokes only part of the decision, the rest of the decision will be confirmed.
The Commission will reject any late or inadmissible appeals. If the decision has already come into force, the Commission then examines whether the requirements for a revision of the decision under a reconsideration procedure or for re-opening of the proceedings are met. If the Commission finds reasons to initiate a reconsideration procedure, to re-open the proceedings or to issue a new decision, late and inadmissible appeals will be considered as grounds for a reconsideration procedure or as applications for re-opening of the proceedings or as applications for a new decision.
1 § 37(2) of the Administrative Procedure Code.
