Countries exempt from South African Visas
PASSPORT HOLDERS WHO ARE EXEMPT FROM VISAS FOR SOUTH AFRICA
SUBJECT TO CHANGE WITHOUT NOTICE
1.The holder of a national South African passport, travel document or document for travel purposes does not require a port of entry visa to enter the country,
2.A staff member of the Southern African Development Community (SADC) who travel on a SADC laissez-passer does not require a port of entry visa for bona fide official business visits up to 90 days and when in transit.
3.Holders of United Nations Laissez-passers; volunteers attached to the United Nations; persons involved in any United Nations agency and persons performing services on behalf of the United Nations, including their spouses, dependent relatives and other members of their households, do not require port of entry visas when visiting the Republic for periods not exceeding 90 days, including official visits, transit or when applying for accreditation for placement at a UN mission in the Republic: Provided they are in possession of the relevant letters or identification documents to identify themselves at ports of entry as personnel of a United Nations agency.
4.Members of foreign military forces attending any military related matters with the South African National Defence Force do not require port of entry visas or study visas, irrespective of their duration of stay, provided that they are in possession of valid passports and letters of invitation by the South African National Defence Force, as well as letters of consent from the military force of which they are members.
5. Foreign commercial heavy-duty vehicle drivers from Lesotho, Botswana, Kingdom of Eswatini, Namibia, Zambia, Zimbabwe and Malawi do not require port of entry visas when entering the Republic, provided their visits do not exceed the period for which their respective countries enjoy visa free entry and on condition that they can produce a letter confirming their employment with a transport company abroad. Visitor’s visas in terms of section 11(1)(a) of the Immigration Act, with authorisation to conduct work in terms of section 11(2) of the said Act, may be issued for the period of the visa exemption status of the respective country, which period may not exceed 90 days at a time.
6.General Work Visas are not required by foreign commercial heavy duty vehicle drivers who are employed by South African companies and originate from countries which enjoy visa free movement into South Africa, on condition that they can produce a letter confirming their employment on entry. In accordance with a High Court ruling by the North Gauteng High Court on 31 March 2011, foreign commercial heavy duty vehicle drivers may be issued with visitor’s visas in terms of section 11(1)(a) of the Immigration Act, with authorisation to conduct work in terms of section 11(2) of the said Act for the period of their countries’ visa exemption status, which period may not exceed 90 days at a time.
7.With effect from 18 December 2015 travellers, with the exception of deportees, who transit through O R Tambo International Airport; Cape Town International Airport; King Shaka International Airport and Lanseria International Airport do not require transit visas as contemplated in section 10B(4)(a) of the Immigration Act, 2002 (Act No 13 of 2002). However, transiting passengers will be subjected to biometric capturing. Deportees transiting at any port of entry are required to be in possession of a transit visa at all times and must be escorted.
8.The attached Schedule outlines national passport holders from countries who are exempt from port of entry visa requirements, the category of passport holders who are exempt from port of entry visa requirements and the period for which such visa exemption applies. Where a national passport holder of a specific country is required to be in possession of a port of entry visa to proceed to South Africa, the list also outlines whether or not an administrative processing fee is payable or not. Please note that countries marked with an asterisk are only subject to visa fees if the intended visit exceeds thirty (30) days
9.All travellers to South Africa are advised that if you are the holder of a national passport of a country whose passport holders are exempt from visa requirements, but your individual visa exemption has been officially withdrawn, a port of entry visa application must be submitted through the South African Embassy/ High Commission/ Consulate General in your country of origin or of long-term residence.

Overview
PURPOSE OF A VISA
A visa only enables the holder to proceed to a port of entry before or on the expiry date of the visa, where the holder must comply with the applicable law, regulations and the following requirements of the Republic of South Africa. No fixed travel arrangements must be made prior to the issuing of the visa and an average of 10 working days must be allowed for the processing thereof.
DURATION AND PURPOSE OF STAY
The period of residence in the RSA will be determined from the applicant’s date of admission to the Republic in accordance with any conditions that may appear on the visa. On admission, the visa will be deemed to be a visitor’s permit. Applicant must ensure that they request the full duration of their intended visits as renewals are subject to additional fees.
Applicant must also ensure that they apply for the correct visa (transit or visitor’s) or temporary residence permit reflecting the true purpose of the visit, as any change in the purpose of stay will only be approved in the RSA for good cause and if the requirements of the Act are complied with.
WARNING
Any applicant allowed entry into South Africa due to any misrepresentation, or false declaration on application form or who sojourns in the Republic in contravention of his / her visa permit conditions shall be guilty of an offence and liable on conviction to a fine or to imprisonment as an illegal foreigner

Visa Fees
At the time of submission of a visa application, the full applicable fee has to be paid. The fee will not be reimbursed in case the application is withdrawn or refused. The visa fee has to be paid cash in the local currency, GHS, according to the applicable exchange rate. Below are the fees for both Visa and VFS service fee.
Note: foreigners holding diplomatic or service passports and Indian nationals are exempted from visa fees but will be required to pay VFS service fee.

Documents Required
Failure to complete application form in full may result in the visa being delayed, refused or rejected at the visa application Centre.
All documents in a language other than English must be translated.
- A passport or travel document valid for no less than 30 days after the expiry of your intended visit (2 copies of Bio data page must be attached)
- Passport must contain at least 3 unused pages for entry / departure endorsements
- Visa application Form (DHA-84) Form 11 Fully completed with BLOCK letter and BLACK ink only
- Payment of the prescribed fee (Visa Fees and VFS Service fees)
- Introductory letter from Employer, School or self-introductory letter
- An international yellow-fever vaccination certificate (copy of front page and page with vaccination details must be attached)
- Two colour passport photographs
- flight itinerary
- Proof of accommodation in south Africa (Hotel booking, Utility bill-(Rates and Taxes) or Tenancy agreement)
- Signed Invitation letter from SA company. Please note that it is must for all business applicants to present a signed invitation letter from SA.
- Proof of financial means to pay for your living expenses while in South Africa in the form of :
- Last 3 months recent original Bank statements certified by the bank
- Letter of sponsorship,3 months recent original Bank statement certified by bank and copy of sponsors passport.
- Financial undertakings by the company in South Africa or Employer in Ghanastating clearly who will be financially responsible for flight, accommodation, feeding and any other event that may occure during the stay of the applicant in SA.This is applicable to corporate clients going on business trip, Training, Conference, Workshop, Business Feasibility studies, Meeting and any form of business related visit.
- Please note that, it is a must for all business applicants to provide signed invitation letter from SA.
Corporate Clients
This refers to corporate organizations, accredited/verified by Department of Trade and Industry, (DTI) intending to, amongst others, but not limited to, conduct business feasibility studies in South Africa, training, meetings. The applicants will therefore be EMPLOYEES of the particular organization, and not clients of those organizations. Once the outsourcing solution, (VFS) is operational, the individual applicants should present themselves to the Visa Application Centre, VAC.
SECTION (11) CLAUSE 2 (90) DAYS WORKING VISA APPLICATION
In addition to all documents listed above, applicants who are applying for Section (11) Clause2 must also provide a signed letter from SA employer, a signed letter from applicant’s local current employer. Both letters must clearly state Section (11) Clause 2 explicitly.
Applicant must also provide the work contract clearly stating the work condition and the (90) days period.
All applicant under this category must be reminded that, visas are only granted for (90) days and allowed to engage in work for this period only.
Remember, you MUST submit your visa application in person.

Photo Specifications
Applicants are requested to submit their Application form with the new photograph not more than one month old, as explained below.

Photographs
Photographs submitted for identity documents and passports must comply to the following specifications:
- Height Length - 45mm
- Width - 35mm
- The background of the photograph shall be white or grey and free of shadows.
- Only the head and shoulders of the person concerned shall be included in the photograph and the head from the chin to the top of the hair shall not be smaller 22mm and not larger than 25mm
- The person concerned shall be photographed without any head-gear or veil, and any other additions to the face which tend to alter the natural likeness shall be removed.
- Medicated Spectacles may be worn provided that the lenses do not make the eyes invisible. Spectacles with dark lenses may be worn if the person is blind
- The full-face of the person concerned shall be photographed directly from the front, and the head shall not be bent or turned sideways
- The face shall be a recognizable likeness of the person and the head, hair, eyebrows, eyes, nose and moustache or beard, if any, shall be sharply and clearly defined
- Neither the photograph nor the copies thereof may be defaced by holes, pencil ,grease or ink marks or in any other manner

Processing Time
The average processing time is Ten working days. In case the application is incomplete or queried and needs further investigation or in case the application has to be forwarded to the competent authorities for further consideration, the assessment may take weeks or even longer. Visa applicants are therefore advised to submit their applications approximately 4 weeks in advance.
Please note: The outcome of a visa application whether to grant a visa or reject or the turnaround time of visa is the sole prerogative of the South Africa High Commission. VFS Global Ghana is not responsible for any refusal or delay in granting a visa.

Overview
PURPOSE OF A VISA
A visa only enables the holder to proceed to a port of entry before or on the expiry date of the visa, where the holder must comply with the applicable law, regulations and the following requirements of the Republic of South Africa. No fixed travel arrangements must be made prior to the issuing of the visa and an average of 10 working days must be allowed for the processing thereof.
DURATION AND PURPOSE OF STAY
The period of residence in the RSA will be determined from the applicant’s date of admission to the Republic in accordance with any conditions that may appear on the visa. On admission, the visa will be deemed to be a visitor’s permit. Applicant must ensure that they request the full duration of their intended visits as renewals are subject to additional fees.
Applicant must also ensure that they apply for the correct visa (transit or visitor’s) or temporary residence permit reflecting the true purpose of the visit, as any change in the purpose of stay will only be approved in the RSA for good cause and if the requirements of the Act are complied with.
WARNING

Visas for people attending a conference in South Africa
Normal procedures must be followed for applying for a visitor’s visa whether you are from a country that requires you get a visa
The application for a visa must be supported by a letter or invitation for the conference
The conference organizer should notify the Department of Home Affairs that the conference is taking place giving all the relevant details and a list of delegates, if possible
The Department of Home Affairs will then notify all South Africa representatives abroad, authorising them to issue visas to the delegates providing that nothing detrimental is know about the delegate, and that all visitor visa requirements are met

Medical Visit

Overview
This visitor’s visa is issued to people who want to visit South Africa for medical treatment of less than three months. All applications for visits for medical purposes must:
Include a letter from a medical practitioner or medical institution, indicating the nature of the ailment, the reason/necessity for treatment, the period of treatment and particulars of the appointment/s made in South Africa
Include full details of the person or institution responsible for the medical expenses and hospital fees. If your medical scheme or employer will be liable for the expenses incurred, proof of medical cover must be submitted
People who require medical treatment for longer than three months must apply for a temporary residency permit. Emergency patients transported by emergency flights or vehicles will be allowed entry if they do not have a visa. Immigration officers will facilitate their entry by not applying clearance procedures. However,
The person in charge of the emergency flight (or the pilot, the driver of the vehicle or the aircraft /vehicle owner) must report the entry and presence of the patient as soon as possible to an office of the Department of Home Affairs
An immigration officer will visit the patient and if necessary, will issue the necessary medical permit. If the patient does not have a valid passport, she/he will be issued with a permit to legalise his or her stay for the duration of his or her hospitalisation

Notes:
- Tax Compliance 1: if the recipient of the visa is a tax resident in a country that the Republic has an agreement in force with for the prevention of or relief from double taxation under section 108(2) of the Income Tax Act, 1962, the recipient will be required to register with the South African Revenue Service if they are present in the Republic for longer than an aggregate of 183 days during any 12- month period;
- Tax Compliance 2: if the recipient of the visa is not a tax resident in a country referred to in (ii), the recipient will be required to register with the South African Revenue Services.
- The holder of a Remote Work visitor’s visa is not entitled to take up employment in South Africa. As per existing Immigration Regulations, no person holding a remote work visa may apply for a change of status to his or her visa while in the Republic, unless under exceptional circumstances as prescribed for visitors visas.

Intra Company Transfer Work Visa

Overview
Occasionally, multi-national companies may decide to transfer an existing employee from a foreign branch to a branch in South Africa. These employees must apply for intra-company transfer work permits. In such cases, no proof of steps taken to obtain the services of a South African citizen/permanent residence will be required.
The holder of an intra-company transfer work permit issued to them prior to 26 May 2014 for a period of two years, who wishes to continue with an international assignment for the remainder of the four year period, may submit an application for a new intra-company work visa at the Visa Application centre.
However, where an assignee has completed four years of his/her international assignment and the operational needs of the branch, subsidiary or Affiliate Company in South Africa requires the services of the assignee for a further period, an application for a new intra-company work visa needs to be submitted. Such applications must, however, be submitted at the South African Mission in the applicants country of origin or of permanent residence. A new intra-company transfer work visa for a period not exceeding four years may be granted, provided that all prescribed requirements are met.

- An undertaking by the relevant employer that:
- a. A foreigner is only employed in the specific position for which the visa has been issued;
- b. The foreign employee will at all times comply with the provisions of the act and conditions of his or her visa and undertakes to immediately notify the director-general if the employee refuses to comply with the provisions of the act or conditions of the visa; and
- c. A plan is developed for the transfer of skills to a South African citizen or permanent resident.
- An undertaking by the relevant employer to reimburse the department any costs incurred in relation to the deportation of the holder of an intra-company transfer work visa and any of his or her dependent family members.

Critical Skills Visa

Overview
The Critical Skills Work Visa will enable the Department and the government to achieve the objectives of programmes such as National Development Plan(NDP), Industrial Policy Action Plan(IPAP) and New Growth Plan(NGP). The Department of Home Affairs has amended the Immigration legislation that came with various changes, which led to the introduction of Critical Skills Work Visa (CSWV).
The Critical Skills Work Visa emanates from the merger of the former Exceptional Skills and Quota Work visas. The latter was issued in line with the Quota List of 2009, which had skills categories, requirements, and the quota of skills targeted in the Republic of South Africa. The Critical Skills work visa is issued in accordance with the critical skills list. The list was developed in conjunction with the occupations in high demand and the scarce skills lists of the Department of Higher Education and Training (DHET). Study Visa

Overview
Study permits are valid for the duration of the course for which they are issued, alternatively 36 months for school and 24 months for other institutions.
As a holder of a study permit you may also apply for permission to work for the purposes of getting work experience, as part of your studies to obtain a diploma or degree by submitting:
- an offer to do practical training
- consent from the educational institution
- proof that you are still a registered student
The Department’s consent to get practical training as part of your studies is issued free of charge provided that you are a registered student and that your study permit remains valid for the entire duration of the training period.
Alternatively, as a foreigner studying at a higher educational institution with a valid study permit, you may work part-time for no more than 20 hours per week. However, you may not work during academic vacations.
The overriding consideration in processing applications for study permits are that:
- No foreigner may displace a South African citizen/resident at a local educational institution
- The student must have proof of sufficient funds to pay for day-to-day living expenses, accommodation as well as tuition fees during his/her stay in South Africa
- The student must have adequate medical cover with a registered South African medical scheme and proof thereof

- Within 30 days, notify the Director-General that the applicant is no longer registered with such institution; and
- Within 30 days, notify the Director-General when the applicant has completed his or her studies or requires to extend such period of study
- Proof of payment of the applicable fee
- Proof of accommodation in SA
In addition to the above requirements, in the case of a foreign state accepting responsibility for the applicant in terms of a bilateral agreement:
- A written undertaking from such foreign state to pay for the departure of the applicant.
- An official letter confirming provisional acceptance or acceptance at that learning institution and the duration of the course.
- An undertaking by the Registrar or Principal of the learning institution to-
- provide proof of registration as contemplated in the relevant legislation within 60 days of registration; or
- In the event of failure to register by the closing date, provide the Director-General with a notification of failure to register within 7 days of the closing date of registration;
- Within 30 days, notify the Director-General that the applicant is no longer registered with such institution; and
- Within 30 days, notify the Director-General when the applicant has completed his or her studies or requires to extend such period of study

- a valid passport;
- proof of physical address and contact number of the adult person residing in the Republic, who is acting or has accepted to act as such learner's guardian, including a confirmatory letter from that guardian; and
- proof of consent for the intended stay from both parents, or where applicable, from the parent or legal guardian who has been issued with a court order granting full or specific parental responsibilities and rights or legal guardianship of the learner.
- An undertaking by the parents or legal guardian that the learner will have medical cover for the full duration of the period of study
- Proof of medical cover renewed annually for the period of study with a medical scheme registered in terms of the Medical Schemes Act.
- Proof of sufficient financial means available to the learner whilst resident in the Republic.
- In addition to the above requirements,in the case of study permit ,the preferred Insurance cover should be from Momentum,Old Mutual or Ingwe Insurance companies.

- The background of the photograph shall be plain and free of shadows and shall not have a white lining

- The person concerned shall be photographed without any head-gear or veil, and any other additions to the face which tend to alter the natural likeness shall be removed. (The Director-General may exempt any person or any category of persons from any of these requirements.)
- Spectacles may be worn provided that the lenses do not make the eyes invisible. Spectacles with dark lenses may be worn if the eyes will appear distorted without them or if the person is blind
- The full-face of the person concerned shall be photographed directly from the front, and the head may not be bent or turned sideways
- The face shall be a recognizable likeness of the person and the head, hair, eyebrows, eyes, nose and moustache or beard, if any, shall be sharply and clearly defined
- Neither the photograph nor the copies thereof may be defaced by holes, pencil or ink marks or in any other manner

Overview
Applications for permanent residency in South Africa are considered in terms of Section 26 (Direct Residency Permits) and Section 27 (Residency-on-Other-Grounds Permits) of the Immigration Act 2002 (Act No 13 of 2002), and read with Regulation 33 of the Immigration Regulations. In terms of granting Permanent Residency Permits, emphasis is placed on immigrants who are in a position to make a meaningful contribution to broadening the economic base of South Africa.

GENERAL REQUIREMENTS
- Application Form (DHA - 947) fully completed in black ink only
- One passport size (45mmx45mm) photographs on white background showing the complete face.
- A valid passport
- Copy of passport data page as well as copies of existing visa and previously issued visas.
- Self-introduction letter with physical address and phone number.
- Copy of international travelling certificate (yellow fever card) duly and fully completed by a health practitioner.
- Proof of financial status (original three months recent bank statement stamped and signed by the bank) or financial support letter from employer with three months recent bank statement) in a case where the Employer is sponsoring company business related the trip. In the event where the applicant is travelling on a private capacity, the bank statement submitted must bear applicant’s name and reflect the salary deposited into the applicant’s bank statement. Sponsored trips should always have a letter with full details of the sponsor and contact details; as well as a copy of identity card/passport data page. - Unabridged birth Certificate for Minors or extract from birth record, where applicable, a consent letter/s with copy/ies of parent/s identification card/passport data page should be attached to the application

SECTION 26 – DIRECT RESIDENCE
Section 26(a) of the Act – Worker
- Proof of five years continuous work permit status
- Proof of registration with professional body, board or council in the Republic, if applicable
- Offer of permanent employment
Section 26(b) of the Act – Spouse of a South African Citizen or Permanent Resident
- Proof that the applicant has been spouse of citizen or permanent resident for five years
- Declaration of support for the application by the spouse who is a citizen or permanent resident
- Identity document of the spouse who is a citizen or permanent resident.
If the spouse is a permanent resident, a copy of his or her permanent resident permit must be submitted.
Section 26(c) of the Act – Child of a citizen or Permanent Resident
- Consent of both parents and guardians, together with an undertaking to provide financial support to the applicant
Section 26(d) of the Act – Child of a citizen
- An undertaking by the South African citizen parent(s) to provide the required financial support to the applicant.
SECTION 27 – RESIDENCE ON OTHER GROUNDS Section 27(a) of the Act
- An offer of permanent employment
- An original clipping, not older than four months at the time of application, from the national printed media –
- Reflecting the full particulars of the relevant newspaper or magazine, as well as the date on which the advertisement was published;
- Stipulating the minimum qualifications and experience required to fill the position;
- Clearly define the position offered and the responsibilities to be performed;
- Measure at least 60 millimetres by 60 millimetres; and
- State the closing date for the application
- Proof that the application falls within the specific professional category or within the specific professional category or within the specific occupational class contemplated in section 19(1) of the Immigration Act.
Section 27(b) of the Act – Critical Skills
- Proof that the applicant falls within the critical skills category as published from time to time by the Minister by notice in the Gazette in the form of certificate from the professional body, council or board recognized by SAQA in term in term section 13(1)(i) of the National Qualifications Framework Act or the relevant Department confirming the skills or qualifications of the applicant.
- If required by law, a certificate of registration with the professional body, council or board recognized by SAQA in terms of section 13(1)(i) of the National Qualifications Framework Act
- Proof of post qualification experience of at least five years
- Testimonials from previous employers
- A comprehensive curriculum vitae
- A letter of motivation indicating that the critical skills possessed by the applicant will be to the benefit of the South African environment in which he/she intends to operate and which relates to the critical skill in question.
Section 27(c) of the Act – In respect of an application by a foreigner who intends to establish a business or invest in a business that is not established in the Republic
- A certificate issued by a chartered accountant registered with the South African Institute of Chartered Accountants or a professional accountant registered with the South African Institute of Professional Accountants to the effect that –
- At least an amount in cash as determined from time to time by the Minister, after consultation with the Minister of Trade and Industry, by notice in the Gazette, is available; or
- At least an amount in cash and capital as determined from time to time by the Minister, after consultation with the Minister of Trade and Industry, by the notice in the Gazette, is available to be invested in the Republic.
- A business plan outlining the feasibility of the business, both in the short term and long te
- An undertaking that at least 60% of the total staff compliment employed in the operations of the business are or shall be citizens or permanent residents employed permanently in various positions
- An undertaking to register with the South African Revenue Service
- Proof of registration with the relevant professional body, board, or council recognized by SAQA in terms of section 13(2)(i) of the National Qualifications Framework Act, where applicable.
Section 27(c) of the Act – In respect of an application by a foreigner who has established a business or invested in an existing business in the Republic
- A certificate issued by a chartered accountant registered with the South African Institute of Chartered Accountants or a professional accountant registered with the South African Institute of Professional Accountants to the effect that –
- At least an amount in cash as determined from time to time by the Minister, by notice in the Gazette has been invested in the business; and
- Proof that at least 60% of the total staff compliments employed in the operations of the business are citizens or permanent resident employed permanently in various positions.
- Proof of registration with the –
- South African Revenue Service;
- Unemployment Insurance Fund;
- Compensation Fund for Occupational Injuries and Diseases;
- Companies and Intellectual Properties Commission (CPIC); and
- The relevant professional body, board or council recognized by SAQA in terms of section 13(2)(i) of the National Qualifications Framework Act
- Financial Statement in respect of the preceding financial year
- A partnership agreement, if applicable
Section 27(d) of the Act – Refugees
- Proof of five years continuous refugee status in the Republic
- Certificate from the Standing Committee for Refugee Affairs that the applicant will remain a refugee indefinitely
- An affidavit regarding aliases used for refugee status applications(s) by the principal applicant or family members, if applicable
Section 27(e) of the Act – Retired Person
- Proof of a pension fund or an irrevocable retirement annuity or a net worth or a combination of assets realizing the minimum amount per month as determined from time to time by the Minister by notice in the Gazette
Section 27(f) of the Act – Financially Independent
- Proof of a net worth in the amount determined from time to time by the Minister by notice in the Gazette
- Written undertaken to make payment in the amount determined from time to time by the Minister by notice in the Gazette to the Director-General upon approval of the application.
Section 27(g) of the Act
- Proof of kinship in the first step between the applicant and the citizen or permanent resident
